Terms of Service

These Terms of Service (“Terms”) govern your use of ICAN Talent, an AI-native recruitment platform operated by ICAN MENA FZ-LLC (“ICAN”, “we”, “us”), a company registered in Dubai, United Arab Emirates. By creating an account or using ICAN Talent, you agree to these Terms.

1. The service

ICAN Talent provides software-as-a-service for recruitment workflows including requisition management, candidate sourcing, AI-powered scoring, interview orchestration, offer management, and onboarding. Features available depend on your plan. We may add, change, or remove features over time.

2. Your account

You must be at least 18 years old and authorized to enter into contracts on behalf of your organization. You are responsible for the accuracy of your account information, the security of your credentials, and all activity that happens under your account.

3. Subscriptions and payment

ICAN Talent plans are billed in advance — monthly or annually — at the rates published on the Pricing page. You authorize us to charge your payment method on each renewal date. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are issued only where required by law.

4. Acceptable use

You may not use ICAN Talent to:

• Violate any law, including UAE labour or data-protection law
• Discriminate against candidates on protected grounds
• Process candidate data without lawful basis or candidate consent
• Reverse-engineer, scrape, or copy the ICAN Talent service
• Use the service to send spam or unsolicited recruitment messages

5. Your data

You retain ownership of all data you upload to ICAN Talent — candidate CVs, requisitions, scorecards, and so on. We process this data only to provide the service to you, in accordance with our Privacy Policy and Data Processing Addendum.

6. AI features

ICAN Talent uses third-party large language models (currently Anthropic's Claude, via the Vercel AI Gateway) to generate scores, summaries, and other outputs. AI outputs are recommendations, not decisions. You remain responsible for all hiring decisions made through the platform. We do not allow AI providers to train on your data; zero data retention is configured by default.

7. Confidentiality

Each party will protect the other's confidential information with the same care it uses to protect its own (and at minimum reasonable care). Confidential information does not include information that is public, independently developed, or rightfully received from a third party.

8. Warranties and disclaimers

ICAN Talent is provided “as is”. We warrant that the service will materially conform to its documentation, and that we will use commercially reasonable efforts to maintain availability. We disclaim all other warranties to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, consequential, incidental, or punitive damages. Our total liability for any claim is capped at the amount you paid us in the 12 months preceding the claim.

10. Termination

You may terminate your account at any time. We may suspend or terminate your account for material breach (after notice and a 14-day cure period) or immediately for non-payment. On termination, you may export your data for 30 days; after that we delete it.

11. Governing law

These Terms are governed by the laws of the United Arab Emirates. Any dispute will be resolved in the Dubai International Financial Centre (DIFC) courts.
